JAMMU, Oct 23: President Pratibha Devisingh Patil today promulgated an Ordinance to amend the Central Universities Act, 2009 paving the way for setting up two Central Universities in the State—one in Jammu province and another in Kashmir—thus meeting aspirations of the two regions. The Ordinance was issued by the President of India after it was approved by the Union Cabinet as Parliament was not in the session, official sources told the Excelsior.
The Ordinance, as per the legal practice, is placed before the Parliament whenever it meets for its nod. Sources said the Central Government decided to go for an Ordinance as there were still more than 20 days left for the beginning of winter session of Parliament
A copy of the Ordinance, available with the Excelsior, said: "whereas Parliament is not in session and the President is satisfied that circumstances exist which render it necessary for her to take immediate action. Therefore, in exercise of the powers conferred by Clause (I) of Article 123 of the Constitution, the President is pleased to promulgate the Ordinance which would be called the Central Universities (Amendment) Ordinance, 2009".
Section 3A has been added after Section 3 of the Central Universities Act, 2009.
Section 3A states that the Central University of Jammu and Kashmir established under Sub-Section (4) of Section 3 shall be known as the Central University of Kashmir and its territorial jurisdiction shall be limited to Kashmir division of Jammu and Kashmir.
"Another University shall be established, which shall be a body corporate, to be known as the Central University of Jammu having its territorial jurisdiction extending to Jammu division of the State of J&K", it said.
It added that all assets and liabilities of the Central University of Jammu and Kashmir in respect of the territory of Jammu division of the State shall stand transferred to be the assets and liabilities of the Central University of Jammu.
"Anything done or any action taken by the University of Jammu and Kashmir in respect of the territory of Jammu division of the State shall be deemed to have been done or taken by the Central University of Jammu", the Ordinance read.
It said: "any suit or legal proceedings instituted or continued by or against the Central Universities of Jammu and Kashmir in respect of the territory of Jammu division of the State shall be deemed to be instituted or continued by or against of the Central University of Jammu".
According to the Ordinance, insertion of Section 3A after Section 3 of Central Universities Act will be a special provision with respect to the State of Jammu and Kashmir.
The Ordinance was today published in the Extraordinary Gazette of India.
According to sources, an amendment in the Central Universities Act, 2009 was necessitated as it provided for setting up of only one Central University in a State. The Centre had sanctioned 15 Central Universities in as many States including J&K.
However, trouble brewed up in Jammu after the State Government set up the office of University in Srinagar. Prof Abdul Wahid was appointed as the Vice Chancellor.
Students of educational institutions took to streets and Central University Andolan Samiti (CUAS) was set up to spearhead the agitation in Jammu region to get the Central University on the claim that it was sanctioned for Jammu while Kashmir valley was given the IIM.
Chief Minister Omar Abdullah led a high level Ministerial team to New Delhi and met Prime Minister Dr Manmohan Singh, UPA chairperson Sonia Gandhi, Human Resources and Development Minister Kapil Sibal and others seeking two Central Universities for the State.
Finally, it was on September 25 that Mr Sibal announced the Centre Government’s decision to sanction two Central Universities to Jammu and Kashmir as a special case keeping in view the regional aspirations. However, while granting two Central Universities to the State, the Centre dropped the proposal to give an IIM to the State. The Centre would divert the money for setting up of IIM for the purpose of additional Central University in the State.
According to sources, 11 out of 15 Central Universities have already started running their classes.
Meanwhile, Revenue Minister Raman Bhalla told the Excelsior that the Centre has been requested to depute a team at the earliest for inspection of three sites each for setting up the Central Universities in Jammu and Kashmir divisions.
Most likely, the Central University for Kashmir would be set up in Chief Minister Omar Abdullah’s Ganderbal Assembly segment while the Central University for Jammu could go to Samba district, sources said but added that a final decision vests with the Central team which has to take several issues into consideration like distance to the Central University from Airport, hospital, national highway and colleges etc.

CB begins probe, summons record
JAMMU, Oct 15: Acting immediately on the directions of Chief Judicial Magistrate (CJM), the Crime Branch, Jammu today started investigations into the mysterious death of a Sarwal youth, Rajneesh Sharma in the custody of Ram Munshi Bagh police station in Srinagar district.
Investigations in the case, widely believed to be a death due to torture in police custody, have been handed over to DySP Varinder Singh Manhas, official sources said.
The Crime Branch has summoned entire record pertaining to the arrest of Rajneesh Sharma from Ram Munshi Bagh and Bakshi Nagar police stations of Srinagar and Jammu districts respectively.
The investigating agency has also sought post-mortem reports from the administration in Srinagar and Jammu to proceed with the probe immediately. It may be mentioned that post-mortem of the youth’s body was conducted initially in GMC Srinagar and later in GMC Jammu.
The Crime Branch has to report to the CJM Jammu again on Monday.
Sources said the FIR would be registered depending upon the initial proceedings in the case.

Family warns self immolation: CJM hands over Rajneesh case to CB
JAMMU, Oct 14: Chief Judicial Magistrate (CJM) Jammu today directed the Crime Branch to investigate the alleged custodial death of a youth Rajneesh Sharma at Ram Munshi Bagh Police Station and submit the report at the earliest while as mother, wife and brother of the deceased have warned of self-immolation if the Government failed to provide them justice.
The directions to Crime Branch were passed in a complaint under Section 156 (3) CrPC filed by Anchal Sharma, alias Amina Yousaf, wife of deceased Rajneesh Sharma and his mother Raj Kumari Sharma, wife of late Nanak Chand against SHO Ram Munshi Bagh Police Station and others.
After hearing Advocates Leela Karan Sharma and Vishal Sharma appearing for the complainants, Chief Judicial Magistrate, Y P Bourney said, "in the complaint serious allegations have been leveled against police officers for having allegedly acted as hired goons of the private respondents. So the matter is required to be investigated by the Crime Branch as a youth has lost life in the police custody".
With these observations, the CJM forwarded the complaint to Incharge Police Station Crime Branch for investigation into the allegedly custodial death of Rajneesh Sharma.
In the complaint, the family has prayed for registration of case against the alleged accused namely Mushtaq Ali, SHO P/S Ram Munshi Bagh Srinagar, Abdul Qayoom, ASI P/S Ram Munshi Bagh Srinagar, Mohd Yousaf Marazi, Tariq Ahmed Marazi, Javid Ahmed Marazi, Javid Riaz Bedar, SSP Srinagar, SP Srinagar, SDPO and staff of P/S Ram Munshi Bagh Srinagar, SHO P/S Bakshi Nagar and SDPO West and demanded stern action against them for custodial killing of innocent youth Rajneesh.
Meanwhile, Anchal Sharma, Raj Kumari Sharma and Pawan Sharma have warned of self-immolation if they failed to get justice from the Government, which, according to them, has not shown any seriousness so far to punish the guilty. The family has also refused to take any compensation and compassionate jobs from the Government.
"It is very painful that even after 10 days of Rajneesh’s custodial killing all the accused persons have been moving freely", they said in a joint press conference at their residence this afternoon, adding "this clearly indicates that Government wants to stifle our voice by offering Rs 3 lakh compensation and two jobs as SPOs".
Making it clear that they will not accept any compensation from the Government till stern action is taken against the accused persons, they gave three days time to the Government for handing over the case to Central Bureau of Investigation (CBI) failing which they will start protest outside the Parliament for seeking the intervention of Prime Minister.
"If we fail to get attention of Prime Minister, we will be left with no other option but to go in for self-immolation and for the same only Government will be responsible", they further said.

Nagar, brothers declared as proclaimed offenders
JAMMU, Oct 21: Chief Judicial Magistrate (CJM), Jammu, Y P Bourney today issued a proclamation declaring all three contractor brothers—Choudhary Nagar Singh, Rakesh Singh and Ujjagar (Jaggar) Singh as proclaimed offenders (Ishtihari Mujrim) and directed that the proclamation should be pasted in towns, villages and houses and published in Government gazette and local dailies.
The Special Investigating Team (SIT), probing Amandeep murder case and fudging of weapon of offence and related crimes by arrested police and FSL officials and Choudhary brothers, had moved an application before the CJM few days back seeking declaration of three brothers as proclaimed offenders under Section 87 CrPC as they had been evading arrest for the past over one month.
Sources described declaration of three influential contractors as proclaimed offenders as a major achievement of DIG Jammu-Kathua range Farooq Khan headed SIT which carried out investigations in the case in a professional manner and was about to present the challan in the case in the court of law within the next few days.
The CJM Jammu order said: "a complaint has been made before me that Nagar Singh alias Nago, Rakesh Singh and Jaggar Singh, sons of Kohla Ram, residents of Gandhi Nagar and Satwari are suspected to have committed the offence under Sections 302/34/201/120-B/409 RPC and 3/25/27 Arms Act.
"It has been shown to my satisfaction that the said accused have been concealing themselves to avoid the service of said warrant. Proclamation is hereby made at the said accused persons, who are required to appear/surrender at Jammu before this court or Incharge SIT to answer the said complaint/allegations on or before 20-11-2009".
Sources said if the trio are not arrested or they didn’t surrender within the period of one month, the process under Section 88 CrPC would be initiated to attach their property.
The CJM Jammu directed that the proclamation should be publicly read in conspicuous place of towns, villages, houses and its copies affixed at court house and published in the Government gazette and local dailies in wide circulation.
Chief Prosecuting Officer (CPO) Pawan Khajuria, appearing for the SIT, submitted before the court that the accused have disappeared from their houses and were hiding themselves to evade the execution of process of law. He placed on record the warrants and reports recorded together with several reports of raids conducted at several places in their search.
Meanwhile, Senior Advocate Sunil Sethi has also been appointed as Special Public Prosecutor in the case of corruption charges against all accused in Amandeep murder case.

Jammu cops suspended for tampering murder evidence
Three senior police officers were on Friday suspended for allegedly tampering with evidence in a murder case in Jammu city.
The home department issued suspension orders of senior superintendent of police (Jammu district) Manohar Singh, superintendent of police (Jammu South) Mumtaz Ahmed and sub-divisional police officer (SDPO, Gandhi Nagar) Jaswant Singh Katock for "dereliction of duties" in connection with the murder case.
Basant Kumar Rath has been posted as the new district police chief of Jammu.
Amandeep Singh, a civilian and son of a former legislator, was murdered in his Shastri Nagar residence in Jammu on August 29. The murder evoked widespread condemnation in Jammu city.
Sources said the government has ordered an enquiry into the alleged fudging of the murder weapon in this case by the suspended police officers in order to tamper with evidence and help the accused.
The station house officer (SHO) of the Gandhi Nagar police station has already been suspended in this connection.
